Competition Terms & conditions

  1. General

Please read these terms and conditions carefully. The terms and conditions set out below apply to all participants submitting entries for Warner Music South Africa competition (the “Competition”) conducted.

  1. These terms and conditions are known as the “Rules”.
  2. Warner Music South Africa reserves the right to cancel or amend all or any parts of the Competition and/or the Rules without notice for any reason that is outside of Warner Music South Africa’s reasonable control. Any changes to the Rules, or cancellation of the Competition, will be posted on the Warner Music South Africa Facebook page. It is the responsibility of entrants to keep themselves informed as to any changes to the Rules by visiting the Facebook Page.
  3. In the event of any dispute regarding the Rules, the conduct or results of the Competition, or any other matter relating to a Competition, the decision of Warner Music South Africa shall be final and unchallengeable, and no correspondence or discussion shall be entered into, comment issued, or reason given in respect of any decision made by Warner Music South Africa.

 

  1. Competition Entrants
  2. By entering the Competition, you hereby warrant that all information submitted by you in your entry is true, accurate and complete in every respect. Warner Music South Africa reserves the right to verify any information contained in your entry and/or your eligibility to enter the Competition.
  3. The Competition is open to persons over the age of 18. Entrants may be required to provide proof of identity. Should the winner be unable to provide any of the required documentation upon request, they will be disqualified.
  4. *The Prize is “Apple AirPods” to the value of R3 000

 

  1. Warner Music South Africa reserves the right in its absolute discretion to disqualify any entrant if he/she is under the age of eighteen or Warner Music South Africa has reasonable grounds to believe that an entrant has breached any of the Rules, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to Warner Music South Africa disqualifying that person, without Warner Music South Africa giving any reason for such disqualification or granting any opportunity for challenge.
  2. Warner Music South Africa’s decision is final, and no correspondence will be entered into.
  3. Only residents of South Africa are eligible for entry into this Competition.
  4. In the event that a Prize-winner is disqualified from the Competition, Warner Music South Africa’s automated system will randomly select an alternative Prize-winner from the entries received in the same manner as the original Prize-winner was selected, and such selection will be subject to these Rules.

 

  1. Competition Entries

The Competition is applicable to anyone who submits a comment as per the rules within the duration of the Competition on the relevant Instagram post.

  1. The winner will be selected on 31 May 2021.
  2. If you enter multiple times, it will be counted as one entry.
  3. Employees, directors, agents, contractors and consultants of Warner Music South Africa and all other participating companies and their immediate families, life partners, associates, or business partners do not qualify to participate or win in the Competition.

 

  1. Prize*
  1. The Prize is “Apple Airpods” , to the value of R3 000
  1. The Prize-winner will be randomly drawn by Warner Music South Africa.
  2. The Prize is not transferable.

 

  1. Prize-winners
  2. The Prize-winner will be randomly 31 May 2021.
  3. The Prize-winner will be notified via email.
  4. Should a Prize-winner not respond to the email message via email within seven days of receiving notice of winning, Warner Music South Africa reserves the right to draw an alternative winner from the remaining pool of entries.
  5. No Prize will be awarded to any entrant who has committed any form of misconduct or breached the Rules of the Competition, as determined by Warner Music South Africa in its sole discretion.
  6. The Prize is non-transferable. In the event of a Prize being unavailable for any reason, Warner Music South Africa reserves the right to substitute prizes of equal or greater value at any time.
  7. The Prize-winner may be required to take part in publicity campaigns for broadcast or publishing purposes; however, the Prize-winner will not be entitled to remuneration in exchange for such publicity. Such publicity includes, but is not limited to, images, statements and information about the winners. All publicity materials remain the property of Warner Music South Africa and their promoters.

 

  1. Liability
  2. Warner Music South Africa accepts no responsibility for any damage, loss, injury or disappointment of any kind suffered by any entrant in entering the Competition, including as a result of any entrant winning or not winning any prize.
  3. Warner Music South Africa accepts no responsibility for entries entered incorrectly.
  4. Warner Music South Africa does not make any representations or give any guarantees that:
  5. Your entry or participation in the competition will necessarily result in you winning a Prize;
  6. a Prize, or any aspect thereof, will meet your requirements, preferences, standards or expectations; or
  7. a Prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.

 

  1. Intellectual Property Rights and Data Protection
  2. Warner Music South Africa will use any personal information that you provide with your Entry for the purposes of the Competition and, where you have given your consent, for marketing purposes including the distribution of regular email or SMS updates or newsletters. Any personal information relating to entrants will be used solely by Warner Music South Africa in accordance with applicable data protection legislation.
  3. The Prize-winners unconditionally agree (as a condition of accepting any prize) to:
  4. the use of their name, one or more photographs of themselves and disclosure of their city of residence; and
  5. co-operate with or participate in any other reasonable post-Competition publicity.

 

  1. Governing Law and Jurisdiction
  2. These Rules shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
  3. The Parties agree that the South African courts shall have exclusive jurisdiction with regard to any matter contemplated herein.
